Terms and conditions
1. Scope of application
These General Terms and Conditions (GTC) apply to all services provided by JAY-COOL SERVICES LIMITED (hereinafter “Provider”) to customers (hereinafter “Customer”) in Great Britain. By ordering a service, the customer accepts these GTC.
2. Conclusion of contract
The contract between the provider and the customer is concluded by a written offer, an acceptance by e-mail, in writing or by a verbal confirmation.
The scope and nature of the services shall be agreed individually and set out in writing in the order or contract.
The Provider reserves the right to refuse orders, in particular if there are special conditions that do not allow the professional provision of services.
3. Services & obligations of the provider
The Provider undertakes to provide the agreed services professionally and with due diligence.
The service shall be provided in accordance with the previously agreed deadlines and standards.
The Supplier shall provide the materials and equipment necessary for the performance of the Services, unless otherwise agreed.
Delays or impossibility of performance due to force majeure (e.g. natural disasters, epidemics, strikes) shall release the Supplier from the obligation to perform without liability for any resulting damage.
4. Obligations of the Customer
The Customer undertakes to allow the Provider access to the relevant premises and to provide a safe working environment.
Valuables and personal items must be secured by the Client before the Service is provided. The Supplier accepts no liability for lost or damaged items unless it can be shown to be at fault.
The Customer undertakes to inform the Provider of any special requirements (e.g. sensitive materials, special agents) prior to the provision of the Service.
5. Prices and payment terms
The prices for the Services shall be agreed individually and set out in the offer or invoice.
All prices are quoted in GBP(Pound sterling) and include VAT where applicable.
Unless otherwise agreed, payment shall be made by invoice within 14 days of the invoice date.
In the event of late payment, the Supplier reserves the right to charge reminder fees and interest on arrears in accordance with the statutory provisions.
6. Cancellation and contract modifications
The customer can postpone booked services free of charge in writing or by e-mail up to one week before the appointment at the latest.
For cancellations within one week, a cancellation fee of 80% of the agreed price will be charged.
Changes to the contract must be agreed in writing or by e-mail.
7. Defects and complaints
The customer is obliged to report any defects in writing within 24 hours of the service being provided. After this period, the service is deemed to have been properly provided.
The Provider has the right to remedy defects within a reasonable period of time following a justified complaint.
A claim for reduction of the price or for damages shall only exist if rectification is not possible or has not been carried out within a reasonable period of time.
8. Liability
The provider is only liable for damages caused by gross negligence or intent.
No liability is accepted for indirect damage, consequential damage or loss of profit.
Liability for damage to particularly sensitive surfaces or materials is excluded unless the Customer has informed the Provider in writing in advance of any special requirements.
The Customer is obliged to take out private household or business insurance to cover any damage.
9. Data protection
The Supplier processes personal data exclusively for the purpose of fulfilling the contract and in accordance with the privacy policy on [company website].
Customer data will not be passed on to third parties unless this is necessary for the fulfilment of the contract (e.g. external payment providers).
10. Applicable law and jurisdiction
These terms and conditions are governed by English law.
The exclusive place of jurisdiction for any disputes shall be London, England, unless mandatory statutory provisions provide otherwise.
